Terms
Version 1.0
Part A – Terms for buyers
1. Scope and marketplace model
Kopftuch.shop is a marketplace. For its own range the contracting party is Kopftuch.shop – Inhaber Md Mahabub Ullah Khan. Where an independent seller is involved, the purchase contract is concluded exclusively between you and that seller, who is named on the product page and in the order confirmation. We are not a party to it and provide only the platform, payment handling and customer service.
2. Conclusion of contract
The presentation of products is not a binding offer. By clicking “Place binding order” you submit a binding offer. The contract is concluded upon our dispatch confirmation or delivery, and in the case of prepayment upon acceptance of your payment.
3. Prices and VAT
All prices are final prices in euro and include statutory VAT where applicable. Whether VAT applies depends on the tax status of the individual seller; sellers using the German small-business scheme (§ 19 UStG) do not charge VAT. Either way the displayed price is what you pay.
4. Payment
Card, Apple Pay and Google Pay via Stripe, PayPal and prepayment by bank transfer. With prepayment we dispatch after the money arrives; if it does not arrive within 7 days we may cancel the order.
5. Delivery
We deliver within Germany and to the countries shown at checkout. An order may contain items from several sellers and will then be dispatched separately, each with that seller's shipping cost. Free shipping is offered by the individual seller, not by the marketplace: whether and from what order value a seller ships free is shown on the product page and in the cart before you place the order, and applies only to that seller's items. Currently all sellers ship free at the latest from 39,99 €; some sellers already from a lower amount. The cart total is always decisive.
Items sold by Kopftuch.shop itself – including items offered under one of our collections (“Collection: …”) – count as items of one seller: they ship together, shipping is charged once, and their value counts together towards free shipping.
Where a seller sets a free-shipping threshold for a single item, only that item's value (price × quantity) counts; other items are not included. The product page states this explicitly.
6. Right of withdrawal
Consumers have a statutory 14-day right of withdrawal. See our withdrawal policy.
7. Liability for defects
The statutory two-year warranty applies. Claims are directed at the seller; please notify us as well and we will mediate and document the case.
8. Reviews
Only actual buyers may review; verified reviews are marked “Verified purchase”. We publish positive and negative reviews alike.
Part B – Terms for sellers
9. Registration
Complete and truthful company, address and tax-status details are required. Approval follows a manual review; products are not publicly visible before approval. The tax status is stored immutably with every order (§ 14 UStG). VAT-registered sellers must provide a valid VAT ID (§ 25e UStG).
10. Commission
12% of the net goods value only – never on VAT, never on shipping. Minimum 1,00 €, maximum 500,00 € per order. The rate is frozen per order line at the time of sale. Withdrawn, cancelled or refunded orders carry no commission. No commission applies to the platform operator's own range; this does not create a claim to equal commission treatment but does not affect equal treatment in ranking.
11. Payout
A payout arises once an order is paid and dispatched, and is released 14 days after delivery, matching the statutory withdrawal period. Minimum payout €10.00.
12. Seller obligations
The seller is solely responsible for product data, own imprint, textile labelling, product safety (GPSR), tax obligations, third-party rights, dispatch within the stated handling time and granting the full right of withdrawal. Counterfeit goods and fake reviews lead to immediate suspension.
13. Termination
Either side may terminate with 14 days' notice. We may suspend an account on reasonable suspicion, stating the reason (Art. 4 Regulation (EU) 2019/1150).
14. Ranking and final provisions
Ranking follows the sorting chosen by the customer. Sellers may book a paid highlighted placement; such placements are always visibly labelled "Sponsored" as required by Art. 7(2) UCPD. A paid placement changes the display order only — price, availability, delivery time and the customer's rights are unaffected, and the customer's chosen sorting is never overridden. The operator's own range is ranked by the same criteria and, being its own goods in its own shop, is not third-party advertising and therefore not labelled. Highlighted slots are limited; bookings are honoured in order of payment and unfulfilled fees are refunded pro rata. German law applies without prejudice to mandatory consumer protection in the consumer's country of residence.
